These Terms of Service (“Terms”) govern your access to and use of the website located at riskresources.org (and any subdomains) and any related services (collectively, the “Service”) offered by RiskResource.Org LLC (“RiskResource,” “we,” “us,” or “our”). Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy (incorporated herein by reference). If you do not agree to these Terms, you may not use the Service.
1. Definitions

“User,” “you,” or “your” means any individual or entity that accesses, browses, submits information, or otherwise uses the Service.

“Content” means any text, images, documents, data, or other information, whether submitted by you or generated by our AI tools, that appears on the Service.

“AI Output” or “AI‐Generated Document” means any document, report, template, or other content generated by RiskResource’s automated, AI‐powered tools in response to your inputs.

“Personal Data” means any information that identifies or can be used to identify an individual, such as name, email address, or IP address.

“Form Submission” refers to any time you provide information (e.g., name, email, organization, building address) through a data entry form on riskresources.org.
2. Acceptance of Terms

Binding Agreement. By using or accessing the Service in any manner (including browsing, registering, or submitting data), you agree to these Terms and our Privacy Policy.

Modifications. We may change or update these Terms at any time. Material changes will be posted here with a revised “Last Updated” date. Continued use of the Service after revisions constitutes acceptance of the updated Terms. We recommend reviewing this page periodically.

By submitting information or documents to RiskResource through any Form Submission, you retain ownership of your original text and data.

You grant RiskResource a non‐exclusive, worldwide, royalty‐free, sublicensable, and transferable license to use, reproduce, adapt, and modify your inputs solely to provide the AI document generation Service.

AI‐Generated Outputs

Unless otherwise noted, RiskResource grants you a perpetual, non‐exclusive, royalty‐free license to use, copy, modify, distribute, and display any AI‐Generated Document that you requested, for any lawful purpose.

RiskResource retains the right to analyze and use anonymized versions of AI outputs for research, quality improvement, and future model training.

Restrictions on Use

You may not reverse‐engineer, decompile, or attempt to extract the source code of our AI models, software, or any proprietary algorithms.

You may not reproduce, distribute, or create derivative works of RiskResource’s website, brand assets, or Service infrastructure, except where expressly permitted by these Terms.

5. Acceptable Use & Prohibited Conduct
You agree that you will not:

Illicit or Harmful Content

Submit any content that is unlawful, defamatory, obscene, threatening, harassing, hateful, or otherwise violates applicable laws or third‐party rights.

Use the Service to create or distribute any content that infringes copyright, trademark, trade secret, or other proprietary rights.

Malicious Activities

Attempt to gain unauthorized access to any part of the Service, or interfere with the proper working of the Service through malicious code, viruses, denial‐of‐service attacks, “scraping,” or other disruptive methods.

Data Harvesting or Spam

Use automated means (e.g., bots, scrapers) to extract data from the Service without prior permission.

Use information gathered through the Service to send unsolicited marketing or spam to any individual or entity.

Impersonation & Misrepresentation

Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.

Provide false, inaccurate, or misleading information to RiskResource or other users.

Regulated Industries

Attempt to use the Service to generate AI documents for regulated industries requiring professional licensure (legal advice, medical diagnosis, or financial advice) without obtaining appropriate professional oversight. Remember that AI‐generated outputs are for informational purposes only.

Violation Consequences. If you violate these rules, we may suspend or terminate your access to the Service without prior notice. We reserve the right to cooperate with legal authorities in investigating any suspected wrongdoing.

AI‐Generated Documents may contain errors, omissions, or inaccuracies. You acknowledge that you must carefully review any AI output before relying on it.

We recommend consulting a licensed professional (e.g., attorney, insurance broker, risk manager, safety consultant) before implementing any policies, procedures, or recommendations generated by the AI.

RiskResource does not provide legal, medical, insurance, or other professional advice. Any information obtained from or through the Service is for informational purposes only and does not substitute for professional guidance.

No Guarantee of Uninterrupted Service

RiskResource does not guarantee that the Service will be available at all times or that it will be error‐free. We may perform routine maintenance or experience disruptions due to technical failures, internet outages, or third‐party service interruptions.

7. Limitation of Liability & Indemnification

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL RiskResource (NOR ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF RiskResource HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL RiskResource’S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS (US $100), OR THE AMOUNT YOU PAID TO RiskResource IN THE PAST TWELVE (12) MONTHS, WHICHEVER IS LESS.

Indemnification

You agree to defend, indemnify, and hold harmless RiskResource and its affiliates, officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

Your violation of any third‐party right (including intellectual property, privacy, or publicity rights); -
Your User Content (inputs) or use of any AI‐Generated Document; -
Any misleading or wrongful acts you undertake through or in connection with the Service.

8. Security Measures & Data Breach Notification

RiskResource employs reasonable administrative, technical, and physical safeguards to protect Personal Data against unauthorized access, disclosure, alteration, or destruction. All data transmissions occur over encrypted channels (HTTPS/TLS).

However, no method of electronic storage or transmission is 100% secure. You acknowledge that there is some inherent risk in online data exchange.

Data Breach Response

In the event of a confirmed data breach affecting your Personal Data, RiskResource will:

Notify affected users no later than 72 hours after discovery (or sooner if required by applicable law).

Provide details about the nature of the breach, the categories of data affected, and steps taken to mitigate harm.

Offer resources and support for identity theft prevention (where appropriate).

9. Payments, Fees & Refunds (If Applicable)
At present, all core AI document generators on riskresources.org are offered free of charge. Nevertheless, RiskResource reserves the right to introduce premium, paid features in the future. If and when we do:

Payment Terms

Fees will be clearly displayed at the time you choose to purchase or subscribe to a premium feature or plan.

Payments will be processed via a third‐party payment processor (e.g., Stripe, PayPal). We do not store your full credit‐card information on our servers.

Billing & Auto‐Renewal

If you subscribe to a recurring plan, you authorize us to charge your designated payment method at the beginning of each billing cycle.

You may cancel or change your subscription before the renewal date by following the instructions in your account settings or contacting support.

Refund Policy

Any refunds (whether full or pro-rated) are at RiskResource’s sole discretion. Unless otherwise stated, fees are non‐refundable once an AI‐Generated Document has been delivered.

10. Termination & Suspension

We may, in our sole discretion and without notice, suspend or terminate your access to the Service (including deleting any account data) if:

You breach any provision of these Terms.

We suspect fraudulent or malicious activity, or any unlawful or abusive behavior.

We discontinue or significantly modify the Service.

By You
-
You may stop using the Service at any time. If you wish to delete your account or personal data, please contact privacy@riskresources.org.

Effect of Termination

Upon termination, your right to use the Service immediately ceases.

Provisions that by their nature should survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will continue to apply in full force.

11. Governing Law & Dispute Resolution

Governing Law

These Terms, and any dispute arising out of or relating to them, shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflicts of law principles.

Forum & Venue

Any legal action or proceeding between you and RiskResource shall be brought exclusively in a state or federal court located in Dallas County, Texas. You and RiskResource each consent to personal jurisdiction in such courts and waive any objections to venue.

Arbitration (Optional)

If either you or RiskResource prefers to resolve disputes through binding arbitration instead of court, the party seeking arbitration must notify the other in writing. If both parties agree, the dispute will be submitted to JAMS (or another mutually agreed arbitration provider) under their rules. The arbitrator’s award shall be final and binding.

Small Claims Exception

Notwithstanding the foregoing, either party may bring an individual claim in small claims court in Dallas County, Texas, provided the claim does not exceed the jurisdictional limit of that court.

12. Amendments & Notifications

Changes to Terms. We may revise these Terms for legal, operational, or other reasons. If material changes occur, we will post a notice on riskresources.org at least 30 days before the new terms take effect (unless immediate change is required by law).

Your Responsibility to Review. It is your responsibility to review these Terms periodically. Your continued use of the Service after changes are published constitutes acceptance of the new Terms.
13. Severability & Waiver

Severability. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.

Waiver. Failure by RiskResource to enforce any right or provision in these Terms will not constitute a waiver of that right or provision.
14. Third‐Party Services & Links

The Service may reference, embed, or rely on third‐party APIs (e.g., OpenAI, cloud hosting, analytics). Your use of those third‐party features is subject to their own terms and privacy policies.

RiskResource is not responsible for the content, practices, or policies of any third‐party websites, links, or resources. Any use of third‐party links or services is at your own risk.
